Civil law workshop聽with Troy McEachren, Lapointe Rosenstein Marchand Melan莽on LLP, whose presentation is titled Selflessness and the Administration of the Property of Another: The evolution from bienfaisance to economic interest as the basis for fiduciary duties in Quebec.

This year, the Paul-Andr茅 Cr茅peau Centre for Private and Comparative Law is launching a new civil law workshop series under the theme "L'abn茅gation en droit civil," examining the aspects and effects of selflessness on civil law.

Abstract

The speaker will trace the evolution from Roman, Ancien Regime to the Civil Code of Lower Canada under which the law of mandate and the office of a testamentary executor was based on bienfaisance or acting gratuitously to art. 1300 CCQ, which flips the paradigm on its head in Quebec. Essentially, selflessness is now replaced with self-interest as an administrator is entitled to remuneration unless the administration is gratuitous.

This workshop has been accredited by the Barreau du Qu茅bec for 1.5 hours of continuing legal education. No registration required.
